Credit Reporting Policy

This policy explains how Smartible (ABN 31 642 337 373), and the company that provides Smartible's services once engagements begin, handles credit information. It is required by Part IIIA of the Privacy Act 1988 (Cth) and the Privacy (Credit Reporting) Code. Our general privacy policy covers everything else.
When we might check
We only consider a credit check when we are asked to accept payment after work starts, for example the milestone balances of a build. Specification Sprints and Operate & Evolve are paid in advance, so they never involve a credit check.
For a company, we may look at public registers and a commercial credit report about the company itself.
Personal credit checks need your consent
We obtain a credit report about an individual (a sole trader, a partner, or a director or guarantor) only if that person has given their own express consent on a separate screen on our platform, after reading our credit notice. A company signatory cannot consent for someone else, and signing an agreement with us is never treated as consent. You can say no. If you do, we may offer payment in advance or a different milestone schedule instead.
What we collect
With your consent, we may collect: identification details; information about applications for credit and the credit you hold; default, court and insolvency information; and any credit score. We obtain it from the credit reporting body named on the consent screen, with its address, phone number and website.
How we use it
We use credit information only to decide whether to offer payment terms and, if payments later become overdue, to collect them. We do not use it for marketing or for anything else.
Who we disclose it to
We do not disclose credit information to credit reporting bodies, and we do not report defaults. We do not disclose it to anyone else except where the law requires.
How we keep it
Credit reports are stored encrypted, outside email, and only the person who makes the decision can see them. We keep them only for as long as we need them for the purposes above, and then destroy them. We keep a record that a check was made.
If we decline or change terms
We make the decision ourselves, not automatically. Before you sign, we tell you the outcome. If the decision relied on a report about an individual from a credit reporting body, we tell that person the body's name and contact details so they can get a free copy of their report.
Access, correction and complaints
You may ask us for access to credit eligibility information we hold about you, or ask us to correct it, by emailing hello@smartible.com.au. We will respond within 30 days. You can complain to us about how we handle your credit information. We will acknowledge a complaint within 7 days and aim to resolve it within 30 days. If you are not satisfied, you can complain to the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au or on 1300 363 992.
If you believe you are a victim of fraud, you can ask the credit reporting body not to use or disclose your information.
